Dutki Terms of Service

These Terms govern use of the Dutki website available at dutki.app.

§1 General provisions

1. These Terms govern use of the Dutki website (the "Service"). 2. The service provider is Marek Galarowicz Usługi Informatyczne, Myśliwska 66D/31, 30-718 Kraków, Poland, Tax ID (NIP): 7352850824, REGON: 384168319 (the "Provider"). Contact: kontakt@dutki.app. 3. These Terms are available free of charge in Polish and English. If versions differ, the Polish version prevails. 4. Using the Service requires creating an Account and accepting these Terms and the Privacy Policy.

§2 Definitions

User — a natural person with an Account. Account — an individual User profile in the Service. Service — SaaS features: budget planning, net worth balances, charts, checkup. Subscription — paid access to full editing after the trial. Trial period — 14 days of full access from creating the first budget or balance, without providing a payment card.

§3 Scope and nature of the Service

1. Dutki allows manual entry, storage, and visualization of financial data. 2. The Service is not financial, investment, or tax advice. Users make financial decisions on their own. 3. The Service does not connect to banks — data comes only from the User. 4. The Provider strives to keep the Service available but does not guarantee uninterrupted operation (maintenance, force majeure).

§4 User Account

1. Registration requires an email address and password. Users must be at least 18 years old. 2. Users must provide accurate data and protect their password. 3. One Account per person (sharing login credentials is prohibited). 4. The Provider may block an Account for Terms violations or legal breaches.

§5 Trial and Subscription

1. New Users receive a 14-day trial starting when they create their first budget or balance. 2. After the trial, full editing requires a Subscription at PLN 7.99 gross per month. 3. Payments are handled by Stripe Payments Europe, Ltd. The Subscription renews automatically each month until cancelled. 4. Without an active Subscription, User data remains available in read-only mode. 5. Cancellation: Settings → Subscription → "Manage in Stripe". Access continues until the end of the paid billing period. 6. VAT invoices are issued by Stripe based on payment details.

§6 Right of withdrawal (consumers)

1. If the User is a consumer, they may withdraw from a distance contract within 14 days without giving a reason. 2. The period starts on the day the Subscription contract is concluded. 3. Exception (digital content): if the User explicitly requests service performance before the withdrawal period ends (e.g. activating a paid Subscription with immediate full access), they lose the right of withdrawal when performance begins. 4. Send withdrawal notices to kontakt@dutki.app. A form template is available on request.

§7 Complaints

1. Complaints about the Service may be sent to kontakt@dutki.app. 2. A complaint should describe the issue, date of occurrence, and Account email. 3. The Provider responds within 14 days of receipt.

§8 Liability

1. The Provider is liable to consumers under applicable law; liability to business users is limited to fees paid in the last 12 months, except for intentional harm. 2. The Provider is not liable for Users' financial decisions or errors in manually entered data. 3. Users are responsible for entered data and lawful storage.

§9 Intellectual property

1. The Service, its layout, code, and Dutki brand are protected by the Provider. 2. Users retain rights to their data and grant the Provider a non-exclusive license to store and process it solely to provide the Service.

§10 Termination and account deletion

1. Users may delete their Account at any time in Settings; this permanently deletes data (subject to legal billing obligations). 2. Deleting an Account cancels an active Subscription via Stripe. 3. The Provider may terminate with 14 days' email notice, or immediately if the User is at fault.

§11 Changes to Terms

1. The Provider may change these Terms for important reasons (law, features, pricing). 2. Users will be notified by email or in the Service at least 14 days in advance. 3. Continued use after changes take effect means acceptance, unless the User deletes their Account.

§12 Final provisions

1. Polish law applies; for EU consumers, mandatory rules of their country of residence remain. 2. Disputes are resolved by competent courts; consumers may use local consumer ombudsmen and the ODR platform: https://ec.europa.eu/consumers/odr. 3. The Provider is not obliged to participate in financial ombudsman proceedings beyond statutory duties.
